Interested parties are encouraged to check www.fauquiercounty.gov under ”Whats New", ”Public Auction" immediately prior to the auction to verify that the property wasnt sold prior to the auction via private offer. If the parcel is auctioned, the auctioneer will have a bidders registration sheet at the auction. In order to register to bid, all bidders must first show Special Commissioner of Sale that they have a certified or cashiers check to make the required deposit if they are the winning bidder at the close of the auction. Deposits are NOT paid upon registration. The only person who will pay a deposit is the winning bidder. Once bidders demonstrate they have a deposit, they will be permitted to register and the auctioneer will give them a number on a paddle for bidding. The winning bidders deposit MUST be tendered immediately at the close of the auction. No time will be allotted for the winning bidder to leave the auction to obtain the deposit. No exceptions. PLEASE, plan ahead for bidding and come to the auction with the necessary funds for deposit. Since no one can know in advance how the bidding will transpire, each prospective bidder should decide prior to the auction what the maximum is he/she is willing to pay for the property. Once bidders decide on their maximum bid, they should simply get a certified check or cashiers check for 20% of that amount. That way, if the bidding goes higher than anticipated and bidders want to increase their bids, their checks will be more than adequate to cover the 10% deposit.
Special Commissioner of Sale reserves the right to withdraw from sale the property listed, to sell at this auction properties not listed, and reserves the right to reject any bid declaring ”no sale" after the last bid received.
Once the highest offer is approved and confirmed by the Court, the balance due will be payable within forty-five (45) days from the date of confirmation of the sale by the Court. ”Date of Sale" is defined as the date of the auction as advertised.

THERE HAVING BEEN PRESENTED to the Court the following resolutions adopted by the Loudoun County School Board (the ”School Board) and the Board of Supervisors of Loudoun County, Virginia (the ”Board of Supervisors"), respectively:
(a) A certified copy of a resolution adopted by the School Board on April 14, 2015, requesting the Board of Supervisors to request this Court to order an election in the County of Loudoun, Virginia (the ”County") on the question of issuing general obligation bonds in the maximum amount of $163, 185,000 for certain school capital projects including ES-31, Dulles North Area Elementary School and HS-11, Dulles North Area High School; and
(b) A certified copy of a resolution adopted by the Board of Supervisors on May 20, 2015, finding it advisable to contract a debt and issue a general obligation capital improvement bonds in the maximum aggregate amount of $153,935,000 to finance school capital projects and other County capital projects as stated therein, and requesting this Court to order a special election for this purpose; and
IT APPEARING TO THE COURT that such resolutions have been duly adopted and that a special election for the purpose set forth herein is authorized pursuant to Virginia Code §§ 15.2-2610 and 15.2-2611; it is hereby ADJUDGED, ORDERED and DECREED as follows:
1. Such resolutions are approved and are hereby filed.
2. The regular election officers of the County shall, on Tuesday, November 3, 2015, that being a day not less than eighty-one (81) days from the date hereof, not within fifty-five (55) days prior to a general or primary election and not the same day as a primary election, hold a Special Election in accordance with § 24.2-681 et seq. of Code of Virginia of 1950, as amended, and take the sense of the qualified voters of the County on the following questions regarding contracting a debt and issuing a general obligation bonds of the County in the maximum aggregate amount of $153,935,000 for the purposes set forth in such resolutions.
3. The ballot to be used at the election shall pose the questions in substantially the following form:

QUESTION: Shall the County of Loudoun, Virginia contract a debt and issue its general obligation capital improvement bonds in the maximum amount of $2,940,000 to finance in whole or in part, the cost to acquire fire and rescue apparatus and the cost of other public safety projects throughout the County approved by referendum?

4. The election shall be conducted, the ballots counted, and the returns made and canvassed in the manner provided by law, and the results thereof shall be certified to this Court, to the State Board of Elections and to the Board of Supervisors.
5. A copy of this Order shall serve as the Writ of Election. The Clerk of this Court shall forthwith send two certified copies of this Order to the Loudoun County Sheriff. The existing Code prohibits tethering of canines when the temperature is less than 25 degrees Fahrenheit and greater than 95 degrees Fahrenheit. The amendmentwould prohibit canine tethering when the temperature is less than 32 degrees Fahrenheit or greater than 90 degrees Fahrenheit. (Tracy Gallehr, Staff)
4. A PUBLIC HEARING CONCERNING REVISIONS OF FAUQUIER COUNTY CODE §15-14 - A public hearing to obtain citizen input on an amendment to Fauquier County Code that would prohibit the discharge of firearms within 200 yards of a regularly occupiedstructure without the owner or occupants permission within a portion of the New Baltimore Service District. The existing County Code prohibition of 100 yards will remain unchanged for the remainder of the County. The portion of the New Baltimore Service District that thiswould effect is bounded by Route 29/15 (Lee Highway) to the north, Route 605 (Dumfries Road) to the west, Route 602 (Rogues Road) to the south and bounded on the west by Riley Road, Broad Run Church Road, Vint Hill Road, then along the Fauquier and Prince William County line to Route 602 (Rogues Road). A PUBLIC HEARING FOR THE PROPOSED SEWER USE ORDINANCE POST- INCENTIVE PERIOD RATE SCHEDULE FOR THE DECENTRALIZED WASTEWATERSYSTEM FOR THE CATLETT AND CALVERTON SERVICE DISTRICTS - A public hearing to consider comments on the proposed Sewer Use Ordinance (SUO) Post- Incentive Sewer Rate Schedule. The Sewer Use Ordinance Post-Incentive Sewer Rate Schedule establishes the fees associated with the system after the expiration of theIncentive Period on August 31, 2015. The Post-Incentive availability fee is $26,000. The estimated monthly user fee is $52. The non-user fee for conforming lots is $52, and for non-conforming lots is $17.33 (Gary Schwartz, Staff).
