In execution of a Deed of Trust dated November 30, 2010, in the original amount of $450,000.00, recorded as Instrument Number 100001283 in the Clerks Office of the Circuit Court of Rappahannock County, Virginia, the undersigned Substitute Trustees, any of whom may act, will on September 12, 2014, at 11:00 a.m., by the front main entrance to the Rappahannock County Courthouse, 238 Gay Street, Washington, Virginia 22747, offer for sale at public auction to the highest bidder the following property with improvements thereon:
All that certain tract of land containing 9.2451 acres, more or less, in Hampton Magisterial District, Rappahannock County, Virginia, about three miles east of the Town of Washington, Virginia, on Virginia secondary route 633, and shown as residue on the plat entitled ”Family Boundary Division Survey Plat Property of Anita Embar, dated November 15, 2005 and prepared by Archie J. Dodson, Jr., L.S., recorded as Instrument Number 060001126 among the land records of Rappahannock County, Virginia

This sale is subject to the restrictions, rights of way, conditions, easements, and mechanics liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust.
Deposit of $20,000.00 by cashiers check shall be required to qualify as a bidder prior to the sale, except from the Noteholder.
The deposit, without interest, is applied to the purchase price at settlement.Settlement will be held on or before fifteen (15) days after sale; time being of the essence. Upon purchasers default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser.
The balance of the purchase price shall be in cash or its equivalent.Settlement shall be at the offices of the Substitute Trustees or other mutually agreed location. The property and any improvements thereon shall be sold in ”as is" condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty including, but not limited to, the preparation of the deed and the grantors tax.In addition, at settlement, the successful bidder shall pay all past due and current assessments, sewer or water charges, and real estate taxes, and any penalties and interest due on any of the foregoing, with respect to the Property prorated to the date of the foreclosure sale, and the purchaser also shall be responsible for all such charges from and after the sale date. The sale is subject to such additional terms as the Substitute Trustees may announce at the time of sale. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale.
