Take notice that a hearing will be held on Thursday, July 23, 2015 in the General District Court of Prince William County on the 2nd floor of the Courthouse located at 9311 Lee Avenue, Manassas, VA at 11:00 am for the Court to determine whether (1) three dogs kept at 3170 Oakmont Street were deprived of adequate care in the days leading up to, and including, July 9, 2015, (2) any such lack of care was attributable to the actions or inactions of Kendrick Evans Cobb, and (3) such dogs should be handled by the Animal Control Bureau consistent with Virginia Code § 3.2-6569(F) and § 3.2-6546(D), which includes placement of the animals for adoption in a suitable home.

Public Notice - Closure Plan
PURPOSE OF NOTICE: To seek public comment on a Groundwater Closure Plan from the Virginia Department of Environmental Quality (DEQ), for the closure of groundwater related to the 1979 drainfield and the 1988 drainfield from a facility located in Calverton, Virginia.

PROJECT DESCRIPTION: CHEMetrics had demonstrated clean closure of soils from the 1979 drainfield and the 1988 drainfield in accordance with the applicable Virginia Hazardous Waste Management Regulations (VHWMR), and the Resource Conservation and Recovery Act (RCRA), pursuant to an amended Consent Order (CO) issued to the facility on February 28, 2011. An approval letter regarding the clean closure was issued by the DEQ on June 20, 2014. The Groundwater Closure Plan provides information and procedures for the closure of the groundwater related to the 1979 drainfield and the 1988 drainfield, at the CHEMetrics facility in accordance with VHWMR consistent with 40 CFR 264 Subparts G and K.
HOW TO COMMENT: DEQ accepts comments by hand delivery, e-mail, fax, or postal mail. All comments must include the name, address and telephone number of the person commenting and be received by the DEQ within the comment period. The public may also write to the contact person at the address below to be added to the facility mailing list. The public may also request a public hearing. To request for a public hearing, the request must be in writing; must state the nature of the issues proposed to be raised in the hearing; and must be made within the public comment period. The public may review both Closure Plans and Fact Sheets at the DEQ Northern Regional Office, 13901 Crown Court, Woodbridge, VA 22193. ALL THAT certain tract or parcel of land lying and being situate about 3 miles southeastof the Town of Warrenton, in Marshall Magisterial District, Fauquier County, Virginia, andbeing described as 45 acres, 1 rood and 39 perches, and known as ”Magbie Hill", withthe metes and bounds description in deed dated January 8, 1887, recorded January 18,1887 in Deed Book 77 at page 420 of the land records of the Circuit Court Clerks Officeof Fauquier County, Virginia;
AND BEING the same property acquired by Dorothy V. Montgomery, now Dorothy Montgomery Rust, in Will of Evelyn M. Montgomery, who died November 10, 1951, dated June 2, 1943, probated November 13, 1951, in Will Book 64 at page 347 of the Clerks Office aforesaid.

Terms of Sale
The sale of this parcel, whether it is sold by private offer or by public auction, is subject to the approval and confirmation of the Court.
CASH WILL NOT BE ACCEPTED. CASHIERS CHECK OR CERTIFIED CHECK IS REQUIRED. NO EXCEPTIONS.
Private, written offers of purchase will be received at any time prior to 12:00 noon on Thursday, July 23, 2015. They must be accompanied by a cashiers or certified check for $1,000.00 or ten percent (10%) of the purchase price, whichever is greater, be made payable to The Fauquier Bank, General Receiver for Fauquier County Circuit Court, and be delivered to Mary Catherine Anderson, Assistant County Attorney and Special Commissioner of Sale, 10 Hotel Street, 2nd Floor, Warrenton, Virginia, 20186. In the event that the purchase price is less than $1,000.00, the entire amount must accompany the offer.
Interested parties are encouraged to check www.fauquiercounty.gov under ”Whats New", ”Public Auction" immediately prior to the auction to verify that the property wasnt sold prior to the auction via private offer. If the parcel is auctioned, the auctioneer will have a bidders registration sheet at the auction. In order to register to bid, all bidders must first show Special Commissioner of Sale that they have a certified or cashiers check to make the required deposit if they are the winning bidder at the close of the auction. Deposits are NOT paid upon registration. The only person who will pay a deposit is the winning bidder. Once bidders demonstrate they have a deposit, they will be permitted to register and the auctioneer will give them a number on a paddle for bidding. If a person cant demonstrate that he/she has a certified or cashiers check to pay the deposit, then that person will not be permitted to bid.
The winning bidder is required to make a deposit of $1,000.00 or ten percent (10%) of the purchase price, whichever is greater, in cashiers or certified check made payable to The Fauquier Bank, General Receiver for Fauquier County Circuit Court. The winning bidders deposit MUST be tendered immediately at the close of the auction. No time will be allotted for the winning bidder to leave the auction to obtain the deposit. No exceptions. PLEASE, plan ahead for bidding and come to the auction with the necessary funds for deposit. Since no one can know in advance how the bidding will transpire, each prospective bidder should decide prior to the auction what the maximum is he/she is willing to pay for the property. Once bidders decide on their maximum bid, they should simply get a certified check or cashiers check for 20% of that amount. That way, if the bidding goes higher than anticipated and bidders want to increase their bids, their checks will be more than adequate to cover the 10% deposit.
Special Commissioner of Sale reserves the right to withdraw from sale the property listed, to sell at this auction properties not listed, and reserves the right to reject any bid declaring ”no sale" after the last bid received.
Once the highest offer is approved and confirmed by the Court, the balance due will be payable within forty-five (45) days from the date of confirmation of the sale by the Court. ”Date of Sale" is defined as the date of the auction as advertised.
The property is offered for sale as-is with all faults and without any warranty either expressed or implied. The property is available for inspection and bidders are strongly encouraged to make their own inspection to determine the suitability of the property and to bid accordingly. Any costs incurred by bidders to inspect the property are at the expense of the bidders and are non-refundable. The property will be conveyed by Deed with Special Warranty of Title. Any costs of title search and all recording costs, including grantors tax, will be at the expense of the purchaser. Announcements made the day of sale take precedence over any prior written or verbal terms of sale.
