In execution of that certain Deed of Trust, dated January 24, 2007, and recorded among the Land Records of Fauquier County, Virginia at Book 1250, Page 1846 (the ”Deed of Trust), Virginia Legal Services, LLC, the duly-appointed Substitute Trustee, will offer for sale the real property generally known as 5493 Old Bust Head Road, Broad Run, Virginia 20137 and all improvements thereon (collectively, the ”Property") at public auction to the highest bidder on:

in front of the main entrance to the Circuit Court of Fauquier County, Virginia located at 40 Culpeper Street, Warrenton, Virginia 20186. The Property is more particularly described as follows:
Beginning at a point on the edge of State Route 694 as dedicated also being a corner common with Frink thence with the line of Frink S. 18 degrees 31 35" East 316.34 to a point, thence through the property of Norris, S. 62 degrees 43 50" West 135.00 feet to a point, thence N. 18 degrees 31 35" West 316.34 feet to a point, thence with the edge of State Route 695 as dedicated N. 62 degrees 43 50" East 135.00 feet to the point and place of beginning and containing 0.96901 acres, more or less.
TERMS OF SALE: A non-refundable bidders deposit in the amount of $30,000.00, or 10% of the sales price, whichever is less, payable in the form of a cashiers or certified check, will be required of the successful bidder (hereinafter ”Purchaser") at the conclusion of the sale, except for the party secured by the Deed of Trust shall not be required to produce a bidders deposit. Substitute Trustee requires all potential bidders to qualify prior to the commencement of the sale by showing evidence of their ability to meet the deposit requirement. The Substitute Trustee reserves the right to waive or modify the requirements with respect to the bidders deposit.
Substitute Trustee reserves the right to withdraw the Property from sale, and to reject any and all bids prior to execution of the Memorandum of Sale.
Purchaser shall assume the risk of loss for the Property immediately after the foreclosure sale. The balance of the purchase price for the Property shall be due at settlement, which shall occur within twenty (20) days after the date of the sale.Substitute Trustee reserves the right to extend the time for settlement; however, TIME IS OF THE ESSENCE. Possession of the Property after settlement shall be the Purchasers sole responsibility. In the event the Purchaser fails to settle on the Property as required, the Purchasers deposit shall be forfeited and the Property shall be resold at the Purchasers risk and expense.
If for any reason the Substitute Trustee is unable to convey title to the Property, the Purchasers sole remedy shall be limited to the refund of their deposit without interest.Upon refund of the deposit to the Purchaser, the sale shall be void and of no further force or effect, and the Purchaser shall have no further claims against the Substitute Trustee.
Except for Virginia Grantor tax, all settlement costs and expenses are the Purchasers responsibility. Real estate taxes will be prorated as of the date of sale.
The Property will be sold AS-IS, SUBJECT TO all encumbrances, rights, reservations, covenants, conditions, restrictions, rights of way, rights of redemption, easements, taxes, municipal liens and assessments, facts that an accurate survey, physical inspection, or check of title of the Property might reveal, agreements of record affecting the same, claims against the chain of title, statutory liens, and all liens and other matters having priority over the Deed of Trust, if any.
Except for the special warranty of title that will be granted via Deed, the Substitute Trustee and the beneficiary under the Deed of Trust disclaim all warranties of any kind with respect to the Property including, without limitation, any warranty relating to possession, compliance with zoning and building codes, extent of construction, fitness for a particular purpose and environmental conditions affecting the Property.
Additional terms may be announced by the Substitute Trustee at the time of sale.

Deposit of $20,000.00 by cashiers check shall be required to qualify as a bidder prior to the sale, except from the Noteholder.
The deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before fifteen (15) days after sale; time being of the essence. Upon purchasers default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser.
The balance of the purchase price shall be in cash or its equivalent.Settlement shall be at the offices of the Substitute Trustees or other mutually agreed location. The property and any improvements thereon shall be sold in ”as is" condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty including, but not limited to, the preparation of the deed and the grantors tax.In addition, at settlement, the successful bidder shall pay all past due and current assessments, sewer or water charges, and real estate taxes, and any penalties and interest due on any of the foregoing, with respect to the Property prorated to the date of the foreclosure sale, and the purchaser also shall be responsible for all such charges from and after the sale date. The sale is subject to such additional terms as the Substitute Trustees may announce at the time of sale. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale.
